NOTICE: Application for Zoning By-Law Amendment AH-ZBA-008/24

Take Notice that the Township of Algonquin Highlands has received a complete application to amend the Township’s Zoning By-law. The site specific amendment applies to land located in Part of Lot 15, Concession A, in the geographic Township of Sherborne, now in the Township of Algonquin Highlands. The civic address is 1055 Haymarket Trail (see key map).

Purpose and Effect: The purpose and effect of the proposed Zoning By-law Amendment is to rezone the subject property from the “Shoreline Residential Two (SR2) Zone to Shoreline Residential Two – Exception (SR2-Exception) Zone” to permit the redevelopment and expansion of a legal non-complying dwelling. The proposed exceptions are to permit relief from:

1. Section 4.14.9. v) of Comprehensive Zoning By-Law 2022-49 to increase the 
maximum gross floor area permitted from 60% to 118% for the purpose of 
constructing a 1389 sq ft dwelling; and;
2. Section 4.2.10. ii) of Comprehensive Zoning By-Law 2022-49 to increase the 
maximum height of a sleeping cabin from 5m (16.4ft) to 7.5m (24.6 feet) to permit the 
construction of an 323 sq ft sleeping cabin.

And Take Notice that the Township of Algonquin Highlands will be holding a Public Meeting as required under the Planning Act. The Public Meeting is an opportunity for Council to hear and consider comments related to the proposed amendments. Any member of the public may speak in favour, or opposition to, the proposed amendments during the Public Meeting.

Members of the public wishing to participate and make comment/speak at the meeting regarding the proposed amendments are required to pre-register by emailing socallaghan@algonquinhighlands.ca before 3:00 pm on June 18th, 2024. 

Additional Information regarding the proposed Amendment is available to the public for inspection at the Township Office located at 1123 North Shore Road in Algonquin Highlands by appointment. Any person can make written representation either in support of or in opposition to the proposed Zoning By-law Amendment.

If a person or public body would otherwise have an ability to appeal the decision of the Council for the Township of Algonquin Highlands to the Ontario Lands Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Algonquin Highlands before the by-law is passed, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Council for the Township of Algonquin Highlands before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Lands Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

If you wish to be notified of the decision of the Township of Algonquin Highlands in respect to the proposed Zoning By-law Amendment, you must submit a written request to the Township of Algonquin Highlands. Concurrent Applications: The subject property is not currently subject to any other 
applications under the Planning Act.
